Otipemisiwak Métis Government Responds to Bill 9

The Otipemisiwak Métis Government expresses deep concern regarding the introduction of Bill 9, the cavalier use of the Notwithstanding Clause by Alberta’s Government and the potential impacts of this legislation on transgender, two-spirit and 2SLGBTQIA+ youth across Alberta.

“Bill 9 signals an alarming trend. The Government of Alberta’s increasing pre-emptive reliance on the Notwithstanding Clause undermines the Charter protections meant to safeguard all people in this country, and particularly minorities and those who are most vulnerable. Invoking the Notwithstanding Clause allows the government to enforce a law even when it conflicts with key Charter-protected freedoms, including expression, peaceful assembly, association, and the right to life, liberty, and personal security.

This clause was intended as an exceptional mechanism, one that should be used rarely and only when absolutely necessary. When governments begin to reach for it repeatedly, and as the first tool instead of the last, as we have seen with forcing teachers back to work and now with Bill 9, it erodes the protections that are designed to shield vulnerable groups from discrimination and overreach. This pattern raises serious concerns about which rights or communities may be placed at risk in the future.”

Historically two-spirit individuals were celebrated within our Indigenous cultures for their ability to walk within both the female and male worlds. Using the Notwithstanding Clause continues a legacy of colonial practice that harms 2SLGBTQIA Individuals and their historical roles of being celebrated within our communities.

Our focus remains on ensuring that Métis youth can access affirming spaces, culturally grounded support, and care that honours their identity and well-being.

As we review this legislation, our commitment remains unchanged, 2SLGBTQIA+ Métis youth deserve safety and acceptance. We will be unwavering in continuing to offer supports to 2SLGBTQIA+ Métis youth and advocating for their rights.”
